2. The concepts used in these Rules mean the following:

"Consumer" is a citizen who has intent to order, or ordered, or using services (work) for maintenance and repair of automobiles exclusively for personal, family, domestic and other needs, not related to the implementation of entrepreneurial activities;

"Contractor" is an organization regardless of the organizational and legal form, as well as an individual entrepreneur who provide consumers (performing work) for maintenance and repair of automobiles for a compensated agreement (hereinafter referred to as the Treaty).

II. Information about services (works), procedure for receiving orders and registration of contracts

3. The performer is obliged to bring to the attention of the consumer. Brand name (name) of its organization, the location (legal address) and its work. This information should be placed on the signboard.

The Contractor - an individual entrepreneur must provide information on state registration with an indication of the name of the authority registered.

In case of temporary suspension of the organization's activities for sanitary, repair and other activities, the Contractor is obliged to inform consumers about the suspension of work and time during which the organization will not carry out its activities.

If the type of activity carried out by the Contractor is subject to licensing, the consumer must be provided with information about the license number, the period of its action and the authority issued by the license.

4. The Contractor must prior to the conclusion of the contract to provide the consumer with the necessary reliable information about the services provided (performed), ensuring the possibility of their proper choice.

This information should be placed indoors where orders are received, in a convenient place for review and comply with:

a) a list of services provided (work performed) and forms of their provision;

b) the names of the standards, the required requirements of which must be complied with the services (work performed);

c) information on the mandatory confirmation of the compliance of the services provided (work performed) established by the established requirements, if such services (work) are subject to compulsory confirmation (number and validity period of a document confirming compliance, an authority issued);

d) prices for services provided (work performed), as well as prices for used spare parts and materials and information on the procedure and form of payment;

e) warranty period if they are installed;

e) information on the timing of orders;

g) an indication of a specific person who will provide a service (perform work) and information about it if it matters based on the nature of the service (work).

5. Information on the mandatory confirmation of the compliance of the services provided (work performed) with mandatory requirements ensuring their safety for the life and health of consumers, ambient And the prevention of damage to the property of consumers is also provided in the form of marking in the prescribed manner a sign of conformity.

6. The Contractor must also provide the consumer to familiarize:

a) these Rules;

b) address and telephone unit for the protection of consumer rights of local governments, if such a unit is available;

c) samples of contracts, orders, outfits, receiving acts, receipts, coupons and other documents certifying the receipt of the order by the Contractor, the registration of the contract and payment of services (works) by the consumer;

d) The list of categories of consumers eligible for benefits, as well as a list of benefits provided in the provision of services (performance), in accordance with federal laws and other regulatory legal acts.

The Contractor is obliged to inform the consumer at his request other related to the contract and the corresponding service (work performed) information.

7. After providing a service (execution of work), the consumer must be brought by providing technical documentation, labeling or otherwise adopted for certain types of services (works), as follows:

a) on the rules and conditions for the effective and safe use of the results of the provision of services (performance);

b) on the service life or terms of shelf life, as well as the necessary actions of the consumer after the expiration of the deadlines and the possible consequences of the failure to fulfill such actions, if the automotive vehicles after the expiration of the deadlines are dangerous for the life, health and property of the consumer or become unsuitable for use for their intended purpose .

8. The Contractor is obliged to provide a timely to the consumer information about his organization and services provided (work performed) in visual and accessible form also in cases where the service is carried out outside the direct location of the organization (in temporary premises, departure brigades, etc.).

9. Information should be communicated to the consumer in Russian and additionally, at the discretion of the contractor, in the state languages \u200b\u200bof the constituent entities of the Russian Federation and the native languages \u200b\u200bof the peoples of the Russian Federation.

10. The performer is obliged to comply with the established (declared) work regime, which for state and municipal organizations is established according to the executive authorities of the constituent entities of the Russian Federation and local governments.

The mode of operation of organizations of other organizational and legal form, as well as individual entrepreneurs, is established by them alone.

11. The Contractor must have a book and suggestions book, which is provided to the consumer at its request.

12. The Contractor takes to implement (fulfillment) only those services (work) that correspond to the nature of its activities.

The provision of services (execution of works) is made according to or without it.

An application for the provision of services (performance) can be served by the consumer in writing, as well as orally (by phone). On the basis of the application, the Contractor appoints the date and time of its arrival and providing an automobile transport to the service (performance of work). The Contractor is obliged to ensure the accounting of applications.

If the consumer at the appointed time did not arrive at the place of work, its service is carried out in the order of the general queue.

13. The Contractor is obliged to conclude an agreement with the possibility of providing the declared service (to fulfill the stated work).

The Contractor is not entitled to provide preference to one consumer before the conclusion of the contract, except for the cases provided for by law and other regulatory legal acts.

14. The contract is concluded upon presentation of a document certifying the person, as well as documents certifying the ownership of an automobile transport (certificate of registration, a passport of an automotive vehicle, a certificate of the account). When surrendered into the repair of individual components of an automobile vehicle that are not numbered, the presentations are not required.

The consumer who is not the owner of the automobile transport means, makes a document confirming the right to operate by automotive remedies.

The consumer who enjoyed the right to preferential service is presents documents confirming that he has such a right. The right to preferential service is preserved for it and in cases where it uses the automotive means by proxy.

When executing and implementing the contract, the documents presented by the consumer are not withdrawn.

15. The Agreement lies in writing (ordering-outfit, receipt or other document) and must contain the following information:

a) brand name (name) and the location (legal address) of the artist organization (for an individual entrepreneur - surname, name, patronymic, information about state registration);

b) surname, name, patronymic, telephone and consumer address;

c) the date of receiving the order, the timing of its execution. If the provision of services (execution of works) is carried out in parts during the term of the contract, the contract must contain a period of time (periods) of providing such services (performing such works). By agreement of the parties, the Contract may also provide for the interimatisfaction of the completion of certain stages of the provision of services (performance);

d) the price of the service provided (work performed), as well as its payment;

e) brand, model of an automobile vehicle, state license plate, numbers of the main aggregates;

e) the price of a car transportation, determined by the Agreement of the Parties;

g) a list of services provided (work performed), a list of spare parts and materials provided by the Contractor, their cost and quantity;

h) a list of spare parts and materials provided by the consumer, indicating information on the mandatory confirmation of their compliance with mandatory requirements, if federal laws or in accordance with the procedure established in accordance with them, in particular standards, such requirements are established;

i) warranty period for the results of work if they are installed;

k) position, surname, name, patronymic of a person who receives an order (drawing up a contract), its signature, as well as the signature of the consumer;

l) other necessary data related to the specifics of the services provided (work performed).

16. The Contractor is obliged to provide a service (fulfill work), a certain agreement, using its own spare parts and materials, unless otherwise provided by the contract.

17. The contract executed in the presence of the consumer (tire swap, diagnostic work, some works of maintenance and repair, washing, etc.), can be issued by issuing a receipt, a token, coupon, cash check, etc.

18. If the consumer leaves the Contractor to the automotive vehicle for the provision of services (performance), the Contractor must simultaneously draw up a receiving act, which indicates a completeness of the automobile transportation and visible external injuries and defects, information on the consumer of spare parts and materials indicating the consumer Their accurate name, descriptions and prices.

A receiving act is signed by the person in the artist and the consumer and is assigned to the artist's seal.

Copies of the contract and the receiving act are issued to the consumer.

19. In case of loss of the contract, the consumer must notify the Contractor. In this case, the automobile transport is issued to the consumer on the basis of his written application for presenting a passport or other identity document.

20. The consumer has the right in his choice to instruct the Contractor to carry out certain types of maintenance and repair work.

The Contractor is not entitled without the consent of the consumer to provide additional services (fulfill work) for the fee, as well as determine the provision of some services (performance) with the mandatory performance of others.

The consumer has the right to refuse to pay for services rendered without his consent (work performed), and if they are already paid, it is necessary to refund the amounts paid for them.

21. The Contractor is obliged to immediately warn the consumer and before receiving the instructions from him to suspend the provision of services (performance) in the case of:

a) detecting the unsuitability or ill-quality of spare parts and materials obtained from the consumer;

III. The procedure for payment provided services (work performed)

23. The consumer is obliged to pay the service provided by the Contractor (performed) in the manner and within the deadlines specified in the contract.

24. The cost of the service provided (work performed) in the contract is determined by the agreement between the Contractor and the consumer. If the consumer fails to fulfill this requirement, the Contractor has the right to terminate the contract in court.

If there was a need to provide additional services (performing additional work) and a significant exceeding the approximate estimate, the Contractor must prevent the consumer in a timely manner. If the consumer gave consent to the excess of the approximate estimate, it has the right to refuse the execution of the contract. IV. Procedure for the provision of services (performance)

33. Article 1089. The amount of harm compensation incurred in the event of the death of the breadwinner.
