In the first spring sun, the already soft winter tires begin to warm up from the warm asphalt. Stiffer summer tires in winter give lower grip and the car simply "carries" along the road, which in itself is not safe.

The second problem is increased wear. GOST the minimum tread height of a passenger car has been set at 1.6 mm, but you shouldn't reach this point, buying a new set already 2 mm. Using rubber out of season will bring your purchase costs closer.

With proper use, a set of rubber will last up to three years, but if you do not change it, then the wear rate will increase by an average of three times. Studded tires serve well in the cold season, but with the establishment of heat and complete clearing of the asphalt from ice, the spikes simply fly out of it, forcing you to buy a new set for the next season. The reasons why you shouldn't skimp on rubber replacement are clear, so when is the time to do it?

Let's start with the fact that at the moment in Russia there is no full-fledged law that has come into force that obliges to change rubber as such, or sets a time frame for such a replacement. In the USA and Finland, the change dates are fixed. If the inspector sees the car “shod out of season”, the driver will be fined.

In Russia, there is a technical regulation on the safety of wheeled Vehicle which prohibits the use of:

  • Studded winter tires in June, July and August.
  • Summer tires on any wheel of a vehicle in December, January and February.

Of course, these are not exhaustive rules and it is imperative to focus on the climatic conditions of a particular region. As for winter tires, experts do not recommend delaying the change of more than 15 November. According to statistics, by this time in most regions of the country there is already a high probability of precipitation in the form of snow or ice.

Administrative Code does not contain an article indicating a fine for using winter tires in summer, but the possibility of its introduction is already being discussed. What are the Technical Regulations and why are they needed?

The confusion over the fine for summer tires in winter (from December to February) arose due to clause 5.5 of the Technical Regulations of the so-called Customs Union of the EAEU.

The technical regulations of the Customs Union are an attempt by three friendly, economically connected states of Russia, Belarus and Kazakhstan to develop common standards for the safety of production and use of the most important products.

Conventionally, the Technical Regulations of the Customs Union can be equated to the Soviet GOST. The idea is to introduce general rules of the game, to bring national standards, regulations and rules to a single modern and safe model.

The technical regulations of the Customs Union regulate about 50 areas, such as pyrotechnic products, packaging, children's toys, food, etc. The rules for the operation of machines should be regulated by the regulations "On the safety of wheeled vehicles" (TR CU 018/2011), which formally entered into effective 1 January 2015.

Among other things, the Technical Regulations of the Customs Union "On the safety of wheeled vehicles" contains clause 5.5, to which the journalists of many major automotive publications refer.

Clause 5.5 of the Technical Regulations of the Customs Union (entered into force in 2015):

It is prohibited to operate vehicles equipped with tires with anti-skid studs during the summer period (June, July, August).

It is prohibited to operate vehicles that are not equipped with winter tires that meet the requirements of paragraph 5.6.3 of this Appendix during the winter period (December, January, February). Winter tires are installed on all wheels of the vehicle.

Winter tires are based on the regulations of the Customs Union, both studded and non-studded rubber products bearing the designation “M + S”, “M&S” and “M S” on the side surfaces, or a pattern in the form of a mountain with three peaks and snowflakes inside it.

Why is there a confusion about a fine for summer tires in winter?

Journalists regarded the harsh wording of clause 5.5 of the Technical Regulations of the Customs Union as a ban on the operation of cars on summer tires oh in winter and on winter tires ah in the summer. However, it is not!

A traffic police officer has the right to fine the driver or vehicle owner solely on the basis of clause of the Code of Administrative Offenses. The confusion occurred because some of the innovations from technical regulations The Customs Union in previous years was transferred to the Code of Administrative Offenses. But there are still no bans on summer tires in winter.

Can a traffic police officer fine for summer tires in the winter of 2017-2018?

However, from some regions of Russia there are reports of issued fines under Part 1 of Article 12.5 of the Administrative Offenses Code of the Russian Federation. The Wheeled Vehicle Safety Regulation contains a strict definition of when winter or summer tires must be fitted to a vehicle.
According to the law, in the summer months (June, July and August), you can use any rubber on the car, except for studded tires, since it negatively affects the road surface. During the winter months (December, January and February), only tires that are designed for winter can be used, while both studded and non-studded tires can be used.

Please note: For use in the winter months in Russian Federation only tires with the following designations are allowed:M +S,M &S orMS. These markings indicate that the tires are intended for winter use. Moreover, such designations may be present on all-season tires, then their operation in winter period allowed. If all season tires do not have such markings, they cannot be used in winter.

It is worth noting that regional authorities have the right to change the terms of use. seasonal rubber... For example, regional government decrees may require the use of winter tires from October to April. At the same time, legislators do not have the right to reduce the terms of prohibition of the use of tires of one kind or another.

From the above, we can conclude that at any time of the year, according to the law, you can use non-studded winter tires. Winter studded tires can always be used, except for the summer period. And summer tires can always be used, except for the winter period.

As you can see, the legislation has no exact date when to change shoes on winter tires, but this must be done before December 1. In Russia, by December 1, there is already an abundant layer of snow on the road, in such conditions it is unsafe to operate a car on summer tires, accordingly, you need to have time to change your shoes in advance.


It is important to remember that when replacing rubber from summer to winter, it is imperative to check the tire pressure, as well as perform similar camber, otherwise all sorts of problems may arise, for example, the car will spontaneously stretch to the side during the movement.

It should be noted that among motorists, November 15 is often called the "Day of the change of summer tires." It is generally accepted that this is the ideal date to replace tires. Please note that studded tires should not be installed in summer, but use of summer tires in winter is prohibited... That is, the regulations allow using winter tires without studs in summer.

Due to the different climatic conditions in the territories where this technical regulation is in force, the periods of prohibition of operation can be increased, but not reduced.

The terms of the prohibition of operation can be changed upwards by the regional government bodies of the member states of the Customs Union.

In accordance with the Decree of the Government of the Russian Federation of July 15, 2013 N 588, since January 1, 2015, amendments have been made to the main provisions on the admission of vehicles to operation. The new version contains clause 5.1 of the list of faults and conditions, under which the operation of vehicles is prohibited.

5.1. Tires passenger cars have a residual tread height of less than 1.6 mm, trucks- 1 mm, buses - 2 mm, motorcycles and mopeds - 0.8 mm.

Note. For trailers, the norms of the residual height of the tread pattern of tires are established, similar to the norms for tires of vehicles - tractors.

5.1. The residual depth of the tire tread pattern (in the absence of wear indicators) is no more than:

  • for vehicles of categories L - 0.8 mm;
  • for vehicles of categories N2, N3, O3, O4 - 1 mm;
  • for vehicles of categories M1, N1, O1, O2 - 1.6 mm;
  • for vehicles of categories M2, M3 - 2 mm.

The residual tread depth of winter tires designed for operation on icy or snow-covered road surfaces, marked with a sign in the form of a mountain peak with three peaks and a snowflake inside it, as well as marked with signs "M + S", "M & S", "M S" ( in the absence of wear indicators), during operation on the specified surface is no more than 4 mm.

Note. The designation of the vehicle category in this paragraph is established in accordance with Appendix No. 1 to the technical regulation on the safety of wheeled vehicles, approved by the Resolution of the Government of the Russian Federation of September 10, 2009 No. 720.

Please note, in accordance with the requirements of the basic provisions for the admission of vehicles to operation there is no prohibition on the operation of vehicles under the conditions described in the technical regulation... That is, in accordance with this document, it is not prohibited to use summer tires in winter.

The new edition adds a requirement for residual depth pattern of winter tires, but there is no obligation to use them. Nevertheless, the requirements of the main provisions on the admission of vehicles to operation do not cancel the requirements of the technical regulation.

Adoption of the law on winter tires

At the end of October 2016, among drivers, the period marked by the theme of winter tires begins. In addition to the usual conversations about where to get auto parts, the topic of a new law on rubber was added.

Disappointing news on TV channels comes from the State Duma, which says about fines for operating tires that are not suitable for the season. Most auto sites claim there is no cause for concern yet.

Fine for tires out of season has existed for a long time, and as for the new bill being considered in the main legislative body, there is nothing out of the ordinary.

The Duma is in the midst of discussing the new "tire" law. Upon entry into force, new law will force car owners to have a tread depth in accordance with (not yet approved) new standards, and these efforts will last from early December to early March. To put it simply, they will be punished for driving on summer tires in the winter.

Another feature, worn-out winter tires are also subject to a fine. They will also be fined for driving on "thorns" on summer roads from early June to early September. In both cases the fine will be as much as 2,000 rubles.

It should be said that the new law on winter tires did not add anything new to the existing rules. Indeed, according to existing standards, in winter only protectors with a depth of more than 1 millimeter for passenger cars are permissible on rubber.

And when driving a car on snow and icy road sections, the depth of the rubber projector according to the regulations should be at least 4 millimeters. Apparently, in the new lawmaking, these requirements were simply toughened, although, according to the old rules, such requirements were also not new.

Why is it forbidden to use summer tires in winter?

  1. Longer braking distances due to the changed composition and pattern of the tire's rubber.
  2. Lack of spikes on the rubber.
  3. The handling of the car is reduced due to the deterioration of wheel traction on ice and snow.

Precisely what was not in the old rules were references to tire seasonality, but similar clauses were contained in other regulations. The law did not enforce a fine for summer tires in winter until 2015, although there were attempts to implement it in 2013. Those regulations, adopted by the Customs Union in 2014, impose a fine for driving on off-season tires.

According to the regulations, the use of summer tires is prohibited in winter, from December to February, and vice versa, in summer from June to August, driving on winter tires is unacceptable.

Why is it forbidden to use winter tires in summer?

This standard has existed for two years. However, specifically in the traffic rules and the Administrative Code there is no clear regulation on the use of off-season tires, to put it simply, there is no such article there. Such violations are assessed only as a violation of the regulation on the operation of transport, without compliance technical requirements... Minimum the fine in such a situation is 500 rubles.

There are specific indications in this provision that regional adjustments to the norms for the use of seasonal tires are permissible, in different weather conditions. In other words, it makes no sense to use summer tires in permafrost conditions, for example in the north. Since such adjustments can only be of a regional nature, this, in turn, leads to misunderstanding on the part of the traffic police, who may not be aware of such amendments. Also, logic dictates that in the southern regions of the country it would be possible to reduce the period of wearing winter tires, but unfortunately, the regional authorities have more powers to increase such a period, and not to reduce it.

If you understand already existing norms, then it becomes clear the desire of the deputies to introduce just such laws. They (the deputies) are trying to correct these conflicts in the law so that traffic rules prohibit driving on spikes in the summer months from June to August, and vice versa, a complete ban was imposed on summer tires in the winter from December to February. And the amendments made to the Administrative Code were supposed to form a clear article and a fine of 2 thousand rubles... As you can see, there are no “apocalyptic” changes in the laws, and motorists have nothing to fear.

The tasks facing the deputies urge them to activate these laws starting from December 1, and there are chances for this. The authorities at all levels, as well as the concerned public, all of them support these ideas. You can't joke with the safety of driving in winter conditions, using summer tires, no motives to save money are inappropriate here. Also, the destruction of the asphalt surface in summer must not be allowed by riding on studded winter tires.
