Change summer tires for winter, according to the law, it is necessary in accordance with the provisions of the current regulatory legal acts. They fix the terms according to which the procedure must be performed, and also fix the punishment for non-compliance with the rules. If a person has disregarded the provisions of the law on winter tires, a fine may be applied against him. What is the law governing rubber replacement?
The peculiarities of using and replacing rubber are fixed in Appendix No. 8 to the technical regulations of the customs union. It is valid from 01.01.2015. A regulatory act sets out the requirements for the safe use of a vehicle. After the adoption of the Regulation, car owners must necessarily change summer tires to winter tires and vice versa.
The provisions of the regulatory legal act concern passenger cars... Features of replacing tires on buses or freight transport are not fixed in the Regulations. The norm does not fix fines for non-compliance with the requirements. Experts view a regulation as a list of recommendations. It will not be possible to punish for non-compliance.
Why can't rubber be used out of season?
The need for a law on winter tires arose because of the danger that it poses to itself untimely replacement tires. A driver who continues to drive summer tires on an icy road runs the risk of losing control. It creates a danger not only for itself, but also for other vehicles and pedestrians. By neglecting the rules, a person runs the risk of facing the following situations:
- become a participant in an accident due to an increased braking distance;
- not be able to overcome even a not too steep climb due to the fact that the car is slipping;
- become the culprit of traffic congestion due to non-compliance with the speed limit.
Technical specifications
Summer tires differ from winter ones in tread depth. For rubber used in the warm season, the indicator value must be at least 1.6 mm. During the period when ice forms on the road, it is allowed to use tires with a tread depth of 4 mm. If the tread is worn out, you will need to replace the tires immediately. Otherwise, the machine may be declared invalid. This will allow the traffic police officer to apply a fine against the driver.
To make it easier for the layman to understand the types of tires, manufacturers put markings on the product. It is allowed to use:
- Summer tires from March to November. They have no markings.
- From September to May - winter studded tires. They are marked "M + S" (Mud + Snow) and / or "Winter".
- All year round - studless winter tires. They are marked "M + S" (Mud + Snow), "Winter", "All season" or "All weather".
By law, it is necessary to change summer tires to winter ones before December 1. The reverse procedure must be completed by June 1. Such requirements are enshrined in clause 5.5 of Appendix No. 8 of the technical regulations of the customs union on the safety of wheeled vehicles. Vehicle... The above norm ascribes to drivers to move in summer on tires without studs, and in winter - on studded tires. However, the regulation contains only recommendations and does not provide for fines.
Penalties can be applied on the basis of Article 12.5 of the Code of Administrative Offenses of the Russian Federation. Its provisions state that faulty car operation is prohibited. The machine will be recognized as such in the following situations:
- the tread depth does not meet the established requirements;
- installed on one axle of the vehicle different tires;
- the tires are damaged;
- studded and non-studded tires are installed at the same time;
- there are cracks on the disc or parts of the attachment are missing;
- the tires do not match the model of the car.
Don't forget about safety requirements. The regulation fixes only the recommended terms. If there is a need, a citizen can perform a replacement earlier. It is worth switching to winter tires when the road is covered with ice several times. It is impractical to carry out actions after the first frost. In Russia, they may occur as early as September.
However, there is no need to hesitate. Keeping a car without winter tires on a slippery road is problematic. It is better to replace it before the moment when the snow completely falls on the ground. The transition to summer tires should be carried out when ice on the road will not appear even at night.
What will happen for non-compliance?
According to paragraph 1 of Article 12.5 of the Administrative Code of the Russian Federation, you cannot use a vehicle if there are malfunctions or conditions are present under which it is prohibited to operate the machine. The use of rubber that does not correspond to the season also falls under this paragraph.
If a citizen has not made a timely replacement of tires, a warning may be applied to him. If a person has not corrected the situation, a fine of 500 rubles may be imposed on him when he stops again. A similar rule applies if the driver drives bald tires. However, the penalty is not applied for the use of summer tires during the winter period, but for the non-compliance of the tread depth with the established requirements.
In the provisions of Chapter 12 of the Code of Administrative Offenses of the Russian Federation, there are no references to the norms enshrined in the technical regulations of the customs union. This means that it is impossible to fine the driver for driving on tires that do not correspond to the season. However, this can be considered a malfunction. In this situation, Article 12.5 of the Administrative Code of the Russian Federation comes into force.
Today, the development of the law on winter tires continues. So, the State Duma committee proposed to increase the amount of the fine for the use of tires that do not correspond to the season, up to 2,000 rubles. However, to date, the bill has not yet been adopted.
Every year car owners are faced with a problem - when is it better to "change shoes" for the cold season, because there was no legislative project concerning this issue before. Of course, the traffic rules clearly spell out the conditions for the seasonal use of winter and summer tires, their characteristics and labeling, but you will not find information regarding when exactly it is necessary to change tires in these rules. Fortunately, or maybe vice versa, on November 1, a strict framework was established when motorists should switch to winter tires in Russia. The law was actively discussed back in 2013, the corresponding bill was developed in January this year, but these requirements came into force only on November 1, 2015. When are winter tires required by law?
According to the CU TR (technical regulations of the customs union) "On the safety of wheeled vehicles", it is prohibited to operate a car equipped with studded tires in the summer months (clause 5.5 Appendix 8 TRTS 018/2011), as well as driving on "bare" tires in December , January and February (clause 5.6.3). Besides, winter tires must be installed on all wheels of the vehicle.
Thus, the winter tire law states that in winter you can use either studded or non-studded (all-season) tires with the MS, M + S, or M&S markings and the corresponding tread pattern, depth and height. If this marking is absent, the use of tires in winter period prohibited.
Important! The ban on the use of seasonal tires can be extended or reduced in accordance with the requirements of local authorities. In some regions, the use of studded tires is prohibited from May to September, so if you are interested in changing tires to winter ones by law, check the laws of your region.
Based on the above, replace summer tires for the winter, you need it during the fall (from September to November).
Administrative responsibility
To date, the law on winter and summer tires does not imply any administrative liability for non-compliance with the regulations, but you can be fined 500 rubles for non-compliance with the requirements for the tread height of tires or for using worn out rubber... The tread depth on the most worn-out area of the tire cannot be less than 4 mm for winter tires, and for summer tires at least 1.6 mm. True, there is one important nuance, which introduces some confusion - a fine can be imposed only when the car is operated on a heavily snow-covered or icy section of the road surface.
Ultimately, it turns out the following: in order to fine the car owner, the traffic police officer must still prove that the driver was driving on an icy surface. And with the tread height it turns out to be an interesting story. If the driver uses winter tires with a tread height of less than 4 mm, then he may be fined 500 rubles. But if he drives summer tires, but at the same time, the tread height corresponds to the norm, then he will not have to worry about his wallet.
Nevertheless, it is possible that in the future, penalties will be imposed on motorists who neglect to replace seasonal tires. Now the initiative of a member of the Federation Council V.A.Tulpanov is being actively considered, who proposes to amend the current regulations in such a way that untimely replacement of summer tires with winter ones is not only prohibited by law, but violators are punished with fines. This bill was brought up for discussion back in 2013, but then its wording contradicted the CU TR, and therefore it was sent back for revision.

As you can see, the new requirements contain a lot of inconsistencies, which so far play into the hands of drivers who do not want to change tires to studded ones. The main provisions of the law that determine the rules for switching from winter to summer tires in cars are as follows:
- On January 1, 2015, amendments to the law regarding the term "winter tires" and its detailed meaning came into force. The amended articles refer to permissible depth protector. However, about seasonal tires when traveling in a vehicle, it is not said;
- Penalties for a shift are allowed by law if the regulations of Part 1 of Article 12.5 of the Administrative Code of the Russian Federation have been violated. That is, if the current wheels do not comply with the technical regulations, the changes of which are prescribed in the articles. The police inspector may not draw up a protocol, but simply give a verbal warning;
- A new technical regulation of the law came into force. The conditions prescribed in it apply to summer and winter tires. In summer, you cannot ride on studded tires from June to August, and in winter, on summer tires from December to February. In accordance with the climatic conditions of the individual regions taken, the shift period can be changed. So far, a fine for such a violation is not provided for in accordance with the legislative provisions in the latest edition.
Therefore, the period for changing from winter tires to summer tires is determined individually, depending on the region and climatic conditions.
Procedure for changing tires for trucks
Changes to the timing of tire change in accordance with the law will affect and trucks... Regional authorities independently determine the period during which only one type of wheel can be used. At the same time, experts argue that deadlocks cannot be avoided.
For example, in order for a truck driver to cover the distance from Sochi to Murmansk, he must change from one type to another several times. Legislative experts are proposing changes to the law, which will determine the exact date of tire change.

Terms of wheel replacement according to the law
In 2017, a bill was passed. Now car owners are obliged to change their wheels at the strictly allotted time - December 1. Due to the different climatic conditions in the territories where this technical regulation is in force, the periods of prohibition of operation can be increased, but not reduced.
The terms of the prohibition of operation can be changed upwards by the regional government bodies of the member states of the Customs Union.
In accordance with the Government Decree Russian Federation dated July 15, 2013 N 588, since January 1, 2015, amendments have been made to the main provisions on the admission of vehicles to operation. The new version contains clause 5.1 of the list of faults and conditions, under which the operation of vehicles is prohibited.
5.1. Tires of passenger cars have a residual tread height of less than 1.6 mm, trucks - 1 mm, buses - 2 mm, motorcycles and mopeds - 0.8 mm.
Note. For trailers, the norms of the residual height of the tread pattern of tires are established, similar to the norms for tires of vehicles - tractors.
5.1. The residual depth of the tire tread pattern (in the absence of wear indicators) is no more than:
- for vehicles of categories L - 0.8 mm;
- for vehicles of categories N2, N3, O3, O4 - 1 mm;
- for vehicles of categories M1, N1, O1, O2 - 1.6 mm;
- for vehicles of categories M2, M3 - 2 mm.
The residual tread depth of winter tires designed for operation on icy or snow-covered road surfaces, marked with a sign in the form of a mountain peak with three peaks and a snowflake inside it, as well as marked with signs "M + S", "M & S", "M S" ( in the absence of wear indicators), during operation on the specified surface is no more than 4 mm.
Note. The designation of the vehicle category in this paragraph is established in accordance with Appendix No. 1 to the technical regulation on the safety of wheeled vehicles, approved by the Decree of the Government of the Russian Federation of September 10, 2009 No. 720.
Please note, in accordance with the requirements of the basic provisions for the admission of vehicles to operation there is no prohibition on the operation of vehicles under the conditions described in the technical regulation... That is, in accordance with this document, it is not prohibited to use summer tires in winter.
The new edition adds a requirement for residual depth pattern of winter tires, but there is no obligation to use them. Nevertheless, the requirements of the main provisions on the admission of vehicles to operation do not cancel the requirements of the technical regulation.
Penalty for summer tires in winter 2017-2018
