Drivers are one of the categories of workers who have special requirements. The specifics of working on a vehicle, which is a source of increased danger, special modes of work, rest leave their imprint on the approach to the organization of remuneration of their labor. 1. General Provisions

The regulation on payment of drivers is developed at enterprises or organizations in order to organize the procedure and conditions for remuneration of drivers, their material incentives (bonuses) and incentives. The regulation should not violate the norms and standards approved by the legislation of the Russian Federation. This document extends its legal force to persons (drivers) carrying out their labor activities on the basis of drawing up an employment contract with the company.

2. Categories of driver's personnel

Here we will not talk about the categories indicated on the driver's license. A wide variety of automotive equipment and areas of its use impose special requirements on the organization of both work and remuneration of employees of road transport departments. Based on these features, several categories of specialists in driving and operating vehicles can be distinguished:

1. passenger vehicle (vehicle capacity does not exceed 5 seats).

2. minibuses (vehicle capacity from 5 to 18 seats).

3. buses (vehicle capacity is more than 18 seats).

4. a specially equipped vehicle (special equipment).

5. freight transport (the carrying capacity of the vehicle does not exceed 3 tons).

3. Remuneration of drivers

Remuneration for drivers - money paid to drivers for the high-quality and timely performance of their duties in accordance with the legislative framework of the Russian Federation, labor agreements, regulations on wages to drivers, as well as additional regulatory documents of the enterprise governing the relationship between the employee and the employer.

Labor remuneration consists directly of wages calculated according to time-based or piece-rate rates, as well as additional bonuses for class and / or working conditions, incentive bonuses and bonuses.

Remuneration for labor depends on the following factors:

  • work schedule (daytime, nighttime).
  1. Time-based (hourly) rates. This calculation system is used for specialists whose duties do not include covering long distances, but require certain skills and mastery. Basically, an hourly payment is charged to drivers:
  • certain special equipment;
  • passenger transport (light vehicles, minibuses, buses), if their work combines expectations (for example, the waiting time of the manager or customers, the waiting time for loading);
  • a cargo vehicle in the case of transportation over short distances of a small weight of cargo.
  1. The piece rate for the mileage traveled. This settlement system can be used for drivers of light vehicles or minibuses performing intercity or international transportation.
  2. Piecemeal rate for passenger turnover. This payment system is relevant for bus or minibus drivers.
  3. Piece rate per tonnage transported or ton-kilometers produced. Piecework earnings are beneficial for specialists who operate freight vehicles and transport bulky goods over long distances (for example, the salary of international workers, which is one of the highest among the driver's staff).

4. Time wages

The use of a time-based billing system is relevant in the following cases:

  • provided that piecework earnings are not beneficial for the employee and may "underestimate" his actual performance, which will significantly affect the final remuneration;
  • if the transport work cannot be normalized;
  • when the transport work performed cannot be taken into account objectively.

This type of payment requires the organization of correct and timely time keeping of the actually worked hours of each employee.

The time wage is calculated as follows:

5. Piecework wages

Piecework earnings are due to the development of the vehicle, which depends on the driver's productivity. Piecework wages are calculated according to piece rates, according to the following criteria:

  • for the distance traveled (km),
  • passenger volume (V p),
  • tons (t),
  • ton-kilometers (tkm).

The use of a piece-rate driver's payment system is relevant in the following cases:

  • when the use of this time-based payment is not relevant and not advisable for the contractor;
  • in the case when it is necessary to evaluate all the subtleties of working conditions and the complexity of the production of the vehicle.
  • when you need to stimulate performers to increase labor productivity: the more you did, the more you earned.

This type of remuneration is beneficial for vehicle management specialists who perform labor-intensive and result-oriented transport work in a relatively optimal period of time. Piecework wages are subdivided into:

  • collective (used when transport production is continuous or long enough, which requires shift rotation of workers in order to organize the necessary rest of the drivers). Collective piecework wages are distributed among drivers, according to the specific weight of their personal output or the coefficient of labor participation.
  • individual - the most commonly used type of piece-rate calculation. It is used when labor protection standards do not require a driver change (usually a work shift does not exceed 12 hours).

Individual driving of the vehicle is more acceptable, since the driver is fully responsible for the volume of production, which is reflected in his wages, as well as for the condition of the vehicle individually. Teamwork involves competition, which can lead to resentment among drivers.

Piecework wages are approved by the employer and comply with the norms of the collective agreement, labor agreement or contract.

This type of earnings requires the organization of reliable accounting of the actual indicators of vehicle production.

The piecework payment of drivers is calculated as follows:

Production can be calculated in:

  1. Distance covered - kilometers. It is typical for the operation of light vehicles carrying passengers over long distances, when the transport works without downtime. Unit of measurement of production: km;
  2. Passenger turnover - transport production is calculated in the volume of passengers transported over a certain distance. Generation unit: V p or V p * km = V pkm
  3. Tonnage - vehicle production is calculated in tonnes transported. Unit of measurement of output: i.e.

Tariffs and coefficients are developed by the labor and wages department (or an authorized specialist), and cannot violate the lower limit of the standards approved by the legislative framework of the Russian Federation.

6. Bonuses for drivers

A well-developed bonus system is an excellent motivation for work for employees and is being developed with the aim of improving various indicators of the financial and economic activity of a transport company (unit).

The absence of bonuses can be a worthy punishment (as well as an example for others) in case of production omissions of the employee and non-compliance by the driver with the job description.

Indicators, conditions and amounts of bonuses should be developed in the regulation on remuneration, as an integral part of the collective agreement.

Indicators of bonuses to employees may depend on:

  • high-quality and timely execution of tasks specified in the waybills;
  • absence of complaints from the consignor and / or consignee;
  • compliance of the vehicle mileage with the distance norms;
  • fulfillment or overfulfillment of the monthly production plan .;
  • the level of quality of work in a team;
  • growth in vehicle output (growth in the productivity of the driver himself);
  • vehicle management within suburban and intercity routes:
  • compliance with the timetable specified in the waybill;
  • high service passenger service;
  • keeping the vehicle in good technical condition;
  • expedient and careful use of the vehicle;
  • saving fuels and lubricants and rubber goods (depends on the manner and nature of driving);
  • combining professions, for example, for freight forwarder drivers;
  • expanding the service area by a car (increasing the volume of transport production);
  • performing the duties of a temporarily absent employee.

7. Payment for categories, class.

The driver's category depends on the vehicle on which he works and the specifics of the operation of this vehicle. The awarded category directly affects the amount of wages, since the tariff rate for a certain type of transport service is developed according to the corresponding category.

The class of drivers (upgrade or demotion) is determined at the enterprise by the qualification commission, which conducts the appropriate certification. The decision on the assignment of class is approved by an order for the enterprise, and a corresponding entry is made in the employee's work book by an authorized person.

The law of the Russian Federation does not provide for the rules regarding the extension of the class of drivers, which was assigned to them at the previous place of work. The decision to maintain the class is made by the head at the new place of work. Most often, at a new job, you will have to reaffirm your awesomeness.

The class of drivers has three levels:

  • III class - a driver starting his work experience;
  • II class - a driver who has a driver's license for driving a vehicle of "B", "C", "E" and / or "D" categories, as well as at least three-year uninterrupted driving (III class) work experience at this enterprise;
  • Class I - a driver who has a driver's license to drive vehicles of "B", "C", "D", "E" categories, as well as at least two years of continuous work as a class II driver at this company.

The premium for class is approved by the head of the enterprise in the form of a fixed coefficient. Basically, for specialists in the management of vehicles of the II class, the size of the class premium is 10%, and for the I class - 25% of the tariff rate for the time actually worked by the driver on the flight. Conditions for conferring a class

The main normative act for establishing the class of drivers is the Qualification Directory of Workers' Professions, which establish monthly salaries (hereinafter referred to as the Directory), approved by the Decree of the State Committee of Labor of the USSR, All-Union Central Council of Trade Unions of Russia dated 20.02.1984 N 58 / 3-102. This Handbook establishes the qualification characteristics of drivers of a certain class. In particular, the 3rd class was received by all drivers who received training and received a driver's license with permitted categories "B", "C" or only "D", 2nd class - "B", "C" and "E" or only "D" ("D" and "E") and 1st grade - "B", "C", "D" and "E".

2nd class must be able to drive cars of all types and brands classified in vehicle categories "B", "C" and "E", or buses of category "D" or "D" and "E", be able to eliminate operational vehicle malfunctions requiring disassembly of the mechanism, carry out adjustment work in the field in the absence of technical assistance, and also know:

Car (bus) driver 1st class must be able to drive cars, trucks and buses of all types and brands assigned to vehicle categories "B", "C", "D" and "E", and must know:

  • purpose, structure and rules of maintenance of road trains, structure and rules of maintenance of cars of the latest releases;
  • the impact of individual performance indicators of vehicles on the cost of transportation;
  • ways to ensure high-performance and economical use of rolling stock;
  • main technical and operational qualities of rolling stock and their impact on traffic safety;
  • elements of the theory of the car;
  • the main provisions of the traffic safety service of a motor transport enterprise.

The second class is assigned with a continuous work experience of at least three years as a driver of a car of the 3rd class at the given enterprise, and the 1st class - with continuous work experience of at least two years as a driver of the 2nd class.

Note that the presence of a class at one enterprise does not at all mean its preservation when applying for a new job. When a 1st class driver is dismissed from one institution, his qualifications are no longer valid when moving to another. It is necessary to pass qualifying "exams" again.

The order of establishing the class

The procedure for assigning a class to drivers is usually prescribed in a local regulatory act. To resolve issues on the assignment (reduction) of a qualification level (class), a qualification commission is created at the enterprise, chaired by the head of the organization or another person appointed by the relevant order. It is recommended to include in the composition of such a commission:

  • a representative of a trade union organization;
  • the head of the personnel department;
  • labor protection engineer.

What gives drivers class?

Assigning a class to drivers allows you to set various incentive payments to wages. According to the norms of Art. 135 of the Labor Code of the Russian Federation of the remuneration system, including the size of tariff rates, official salaries, additional payments and allowances of a compensatory and incentive nature, bonuses, are established by collective agreements, agreements, local regulations in accordance with labor legislation and other regulatory legal acts containing labor law norms. Moreover, local regulations establishing wage systems are adopted by the employer, taking into account the opinion of the representative body of employees.

When developing local regulations (regulations on remuneration and material incentives for employees), the employer independently determines the amount of the premium for the class of drivers. But it must be no less than that established in clause 3.8 of the Federal Industry Agreement on Automobile and Urban Land Passenger Transport for 2008 - 2010 (registered on March 25, 2008 N 96 / 08-10<1>). In organizations of urban land passenger transport, taking into account the established practice, employers, in agreement with the relevant trade union committees, can establish a premium for class:

  • 1st class drivers - 25%;
  • 2nd class drivers - 10% of the established tariff rate for the time worked as a driver.

The same percentage of the additional payment is established by the Industry Tariff Agreement on the organizations of land urban electric transport of the Russian Federation for 2009 - 2011 (dated 28.11.2008 N 106 / 09-11) and some other agreements.

It is necessary to adhere to such agreements by virtue of the Letter of the Ministry of Health and Social Development of Russia dated July 24, 2008 N 338-TG, which states: if, within 30 calendar days from the date of the official publication of the proposal to join the Agreement, employers who did not participate in the conclusion of the Agreement do not submit to the Ministry of Health and Social Development in established by Part 8 of Art. 48 of the Labor Code of the Russian Federation, a motivated written refusal to join the Agreement, the latter will be considered common to these employers.

A number of sectoral regulations have also been developed that regulate the amount of this premium:

If the employer decides to introduce a grade premium, the amount less than that specified in the sectoral agreement, he will not be able to establish.

Lowering the driver class

The class can not only be established, but also lowered (paragraph 7 of the Handbook). The downgrade of the qualification class is announced by the order of the head with the entry into the work book. Drivers who have a downgraded qualification class, as well as those deprived of the right to drive a vehicle for a period of more than a year, the qualification class can be assigned on a general basis again.

It is possible to downgrade if the driver of the 2nd and 1st class:

  • does not fulfill the requirements stipulated by the qualification characteristics or job description;
  • systematically fails to fulfill plans, transportation schedules and traffic schedules;
  • has excessive consumption of fuel;
  • has over the past three years of work violations of traffic rules, resulting in road traffic accidents;
  • violates the technical operation of the vehicle and safety regulations.

To establish the procedure for assigning classes to drivers, the employer must develop a number of local regulations, since the mandatory requirements for assigning a class to the Labor Code of the Russian Federation and regulatory documents containing labor law standards are not established. The necessary conditions for the payment of the allowance are the creation of a qualification commission and ensuring its functioning, the development of a regulation on the calculation of a premium for the class of drivers and a regulation on the assignment of a class to drivers.

Regulations on the procedure for assigning class to drivers of light vehicles

1.1. This Regulation determines the procedure for assigning a qualification class (class) to drivers of light vehicles (hereinafter referred to as drivers) by the city administration _________.

1.2. The assignment of a qualification class (class) to drivers is carried out by the commission for assigning a qualification class to drivers of passenger vehicles of the city administration _________ (hereinafter - the commission).

2.6. The issue of assigning a qualification class is considered by the commission on the basis of the driver's application.

2.7. The assignment of a qualification class (class) is formalized by the order of the head of the personnel department and the municipal service of the city administration _________ on the basis of the commission's protocol.

2.8. The monthly grade premium is set in the following amounts:

  • 2nd class driver - 10% of the official salary;
  • 1st class driver - 25% of the official salary.

3.1. If a driver of the 2nd or 1st class systematically violates the Rules of the Road and Vehicle Operation, at the request of the head of the structural unit, by the decision of the commission, he may be downgraded.

3.2. The downgrade of the qualification class is formalized by the order of the head of the personnel department and the municipal service of the city administration _________ on the basis of the commission's protocol.

3.3. Drivers who have been downgraded can be assigned a class on a general basis, but not earlier than in a year.

4.1. The preparation and organization of the meeting of the commission is entrusted to the secretary of the commission.

4.2. The form of the commission's work is a meeting under the leadership of the chairman or his deputy. A meeting of a commission is competent if attended by at least two-thirds of its members. The decision of the commission is adopted by a simple majority of votes from the number of its members present at the meeting. 4.3. The driver's application for the assignment of a qualification class addressed to the chairman of the commission is accepted by the secretary of the commission. Attached to the application:

  • copy of the work book;
  • copy of the driver's license;
  • an application for the assignment of a qualification class for the head of a structural unit.

4.4. The request of the head of the structural unit to downgrade the driver's qualification class addressed to the chairman of the commission is accepted by the secretary of the commission. Attached to the application are:

  • copies of documents on the imposition of disciplinary sanctions for non-performance or improper performance of labor duties, for violation of technical operation rules, safety rules, work instructions, etc.;
  • copies of documents on violation of traffic rules.

4.5. The secretary of the commission, no later than a week before the start of the commission's work, informs the drivers about the date, time and place of the certification.

4.6. The decision of the commission is drawn up in a protocol, which is approved by the chairman of the commission and transferred to the personnel department and municipal service of the city administration for the preparation of a draft order.

The legality of the introduction of classroom premiums in budget-funded institutions is confirmed (the fact is that in individual institutions in these cases the generally established rule is applied, since the qualifications of workers have already been taken into account in their tariff rates) by a letter of the Ministry of Labor of the Russian Federation of January 18, 1993 No. 63-RB "On allowances, additional payments and other incentive payments ”.

At enterprises related to the field of maritime transport, the necessary conditions for the payment of a class premium to drivers of motor vehicles is the existence of a developed Regulation on the calculation of a class premium for drivers and a Regulation on assigning a class to drivers. 1. This Regulation determines the procedure for assigning a qualification class (class) to vehicle drivers (hereinafter referred to as drivers) of enterprises and institutions of the Polar Region.

2. The main documents for assigning a class to drivers are a work book and a driver's license. A newly hired driver is assigned an appropriate class, confirmed by an entry in the work book and a driver's license.

3. The assignment of a qualification class (class) to drivers is carried out by the commission for assigning a qualification class to vehicle drivers of enterprises and institutions of the Polar Region (hereinafter referred to as the Commission). A driver of the 2nd qualification class must know:

Purpose, device, principle of operation, operation and maintenance of units, mechanisms and instruments of vehicles classified as vehicle categories "B", "C" and "E", and when working on buses ("D" or "D" and "E ") - their malfunctions;

Signs, causes, dangerous consequences, ways to identify and eliminate vehicle malfunctions;

7. Qualification of the 1st class is assigned to a driver who has worked for at least two years as a driver of the 2nd class in municipal institutions (enterprises) of the Zapolyarny District, if he has a permitting mark "B", "C" in his driver's license, "D" and "E".

A driver of the 1st qualification class must know:

Purpose, structure and rules of maintenance of road trains, structure and rules of maintenance of cars of the latest releases;

The influence of individual performance indicators of vehicles on the cost of transportation;

Methods for ensuring high-performance and economical use of rolling stock;

The main technical and operational qualities of rolling stock and their impact on traffic safety;

Elements of the theory of the automobile;

Basic provisions of vehicle traffic safety.

8. In addition to the requirements provided for in clauses 5, 6 and 7 of these Regulations, the assignment of a qualification class to a driver is made subject to:

Conscientious fulfillment of their duties, absence of accidents, overspending of fuel and lubricants and compliance with production and labor discipline;

Absence of violations of the Road Traffic Rules over the last 2 years of work;

No violations of technical operation rules, safety rules and work instructions.

9. The issue of assigning a qualification class is considered by the commission on the basis of the driver's application (Appendix 1). The class is assigned by the commission based on the results of employee certification. Certification is carried out in the form of answers to questions:

Knowledge of the rules of the road and technical operation of the vehicle;

Devices and methods of maintenance and repair of a vehicle.

10. The assignment of a qualification class (class) is formalized by a legal act of the head of an enterprise or institution on the basis of the minutes of the meeting of the qualification commission (Appendix 2).

11. The monthly grade premium is set in the following amounts:

2nd class driver - 10% of the established tariff rate (official salary) for the time worked as a driver;

1st class driver - 25% of the established tariff rate (official salary) for the time worked as a driver.

12. At the request of the head of the structural unit, by decision of the commission, the class of a driver of the 2nd or 1st class may be downgraded on the following grounds:

Systematically violates the Traffic Rules, does not fulfill the requirements stipulated by the job description;

Has excessive consumption of fuel;

Has violations of the Road Traffic Regulations that resulted in road traffic accidents;

Violates the technical operation of the vehicle and safety regulations;

In the case of driving in a state of alcoholic, drug or toxic intoxication.

13. The downgrade of the qualification class is formalized by a legal act on the basis of the commission's protocol.

14. Drivers who have been downgraded can be assigned a class on a general basis, but not earlier than one year later.

15. Drivers who, in accordance with the current legislation, were deprived of the right to drive vehicles, the class is assigned again, starting from the 3rd class, on a general basis, subject to the requirements established by this Regulation.

16. Preparation and organization of the meeting of the commission shall be entrusted to the secretary of the commission.

Driving license class is a value that is assigned to drivers with a certain driving category and work experience in driving a vehicle.

This value was first introduced in 1976. In Soviet times, classes were actively used for employees of many professions, including drivers.

The document later became invalid, but a workers' qualification directory was created in 1984. It is still used to determine the driving class.

The highest, class 1, is available provided that all four main categories are open for the driver: "B", "C", "D" and "E".

How to determine the class of your driver's license

The assignment of a driver's class is not recorded in personal documents. The employee can learn that the qualification has been improved from the order, which is provided for signature to employees.

Without this document, the employer can independently determine a new employee for a position with advanced qualifications, but this is done extremely rarely.

But it is no longer possible to find a job with grades 2 and 1. When you change the place of work, the acquired qualifications are lost.
