At the same time, the regulations state that all wheels of a car must have winter tires, and not only the front or rear axle, as some drivers believe.

In paragraph 5.5 of Appendix No. 8 it is said that the operation of vehicles without winter tires in winter is prohibited. It is also forbidden to use cars with studded tires in summer. It is also clearly stated in this paragraph that you cannot use cars that, although equipped with winter tires, have a residual tread depth of less than 4 mm. Draft Law No. 464241-6 on 01.11.2016 was sent for revision to the Legislation Committee and the Transport Committee. A working group was created from the deputies for revision. The Ministry of Internal Affairs gave recommendations on the procedure for taking into account the peculiarities of climatic conditions in different regions to agree on the terms of use of studded tires. What kind of Technical Regulations are they and why are they needed?

The confusion over the fine for summer tires in winter (from December to February) arose due to clause 5.5 of the Technical Regulations of the so-called EAEU Customs Union.

The technical regulations of the Customs Union are an attempt by three friendly, economically connected states of Russia, Belarus and Kazakhstan to develop common standards for the safety of production and use of the most important products.

The technical regulations of the Customs Union regulate about 50 areas, such as pyrotechnic products, packaging, children's toys, food, etc. The rules for the operation of machines should be regulated by the regulations "On the safety of wheeled vehicles" (TR CU 018/2011), which formally entered into effective 1 January 2015.

Among other things, the Technical Regulations of the Customs Union "On the safety of wheeled vehicles" contains clause 5.5, to which the journalists of many major automotive publications refer.

Clause 5.5 of the Technical Regulations of the Customs Union (entered into force in 2015):

Why is there a confusion about a fine for summer tires in winter?

Journalists regarded the strict wording of clause 5.5 of the Technical Regulations of the Customs Union as a ban on the operation of cars on summer tires in winter and on winter tires in summer. However, it is not!

Is there a fine for winter tires in summer?

If you study the Technical Regulations of the Customs Union TR CU 018/2011 "On the safety of wheeled vehicles", it turns out that it brought new rules for Russian motorists. In this technical regulation, in paragraph 5.5 of Appendix No. 8, there are such provisions on the use of certain car tires at different times of the year:

In fact, in 2020, there is a fine for driving on winter tires in summer only indirectly under Part 1 of Article 12.5 of the Code of Administrative Offenses of the Russian Federation, that is, if you left in the summer with a badly worn out tread ("bald" tires), the depth of which is less than 4 mm, then the fine for bald tires will be 500 rubles(or a warning).

What are the penalties for riding bald tires in 2020?

  • moped or motorcycle - less than 0.8 mm;
  • bus - less than 2 mm.

According to Art. 12.5 of the Administrative Code of the Russian Federation, the traffic police can issue a fine to the driver for this violation - 500 rubles.

According to rumors, the deputies plan in the future at the legislative level to increase the amount of the fine for driving on bald tires by 4 times. Such a leap can be considered quite reasonable, since due to the fault of drivers who drive onto the road on bald tires, a huge number of accidents occur, especially during the winter months, when the roads are icy.

Will there be a ban on studded tires?

We talked about the requirements for vehicle tires in different seasons of the year, and now we will consider the question of what changes regarding the use of studded tires are planned at the legislative level.

For the countries that are members of the Customs Union, the technical regulation TR CU 018/2011, which we talked about above, sets the following conditions:

  • Studded tires must not be used during the summer period - from June to August;
  • Rubber with studded tread must be on all wheels of the vehicle (that is, it is impossible to have both studded tires and non-studded winter velcro tires at the same time;
  • The maximum number of studs is prescribed per running meter of the tread - 60 pieces. This requirement will apply to rubber manufactured after January 1, 2016.

If we talk about potential fines for the use of rubber with spikes today, then they are not established at the legislative level! Therefore, drivers of the countries that are members of the Customs Union should not be afraid of penalties yet. But the fine for driving a car on studded tires, and you do not have the "Spikes" sign, is 500 rubles.

Riding on all-season rubber (Velcro) in 2020

Separately, it is worth mentioning about all-season tires, it is quite comfortable to ride on it by car both in winter and in summer. Actually, such non-studded all-season tires are designed for use on the road all year round.

Please note that such tires can be used in winter only if they are marked as "M + S", "M&S" or "MS" (which means "Mud & Snow", that is, in English "mud and snow" ) and although otherwise the use of all-season tires in the winter months is not allowed, there is still no penalty for this.

Above, we have already outlined the situation regarding the legal framework for seasonal tire change and penalties for the use of out-of-season tires. The penalty is provided for by Part 1 of Art. 12.5 Administrative Code and is equal to 500 rubles.

Mandatory use period for winter tires

The adopted law on studded tires caused a lot of questions and misunderstandings - when is it still necessary to carry out a seasonal tire change in order to avoid the danger of being prosecuted and fined?

If we talk about the timing of replacing tires with winter ones, then the requirements according to the text of the law in force, taking into account the amendments, are formulated as follows:

  • It is forbidden to use tires with anti-skid spikes in the summer;
  • It is forbidden to operate vehicles that are not equipped with winter tires that fully meet the requirements for them in the winter season;
  • According to the regulations, vehicles must be equipped with winter tires for a period of 3 winter months (from December 1 - March 1) and summer tires for a period of 3 months (June - August). In some regions of the Russian Federation, according to the changes introduced by the executive authorities, such norms may be shifted towards their increase or decrease. For example, for Moscow from November 1. Such a wording is exclusively related to the peculiarities of the climate in each region - in some areas winter tires may not be in demand at all, and in others, on the contrary, its presence is required on a vehicle all year round.

Requirements for winter tires

In order not to get into a mess, you should understand exactly which tires, from the point of view of existing standards, can be regarded as winter tires. So, characteristics that winter tires must meet, the following:

  • The minimum tread depth of a tire is 4 mm;
  • The corresponding marking to be applied to the tires is a figure representing a 3-peak peak with a snowflake depicted in the center and its letter designation - M & S, M + S or M S;
  • Lack of visible violations and damage to the tire. Such violations can include delamination of the coating, cuts and punctures, obvious tears, separation of layers along the side parts of the tires;
  • No cracks in the disks, even if the tire itself is in full compliance with all the requirements;
  • Missing part of the mounts on the discs (bolts or nuts);
  • It is forbidden to install on one axle of a car (front, middle, rear, etc.) winter tires that differ in design, their design, model or type, degree of wear;
  • The motorist is obliged to ensure that all wheels of his vehicle have winter tires that meet the requirements. For example, if there are winter tires on three disks, and summer tires on one, such a violation is already equated to driving a vehicle without winter tires.

Separate points that are of interest to vehicle owners is whether it is possible to drive in the winter season by a car with so-called velcro or all-season tires used as tires. In the event that such tires meet the necessary requirements in terms of their technical parameters and have the appropriate marking, then their use is not considered a violation.

It should be understood that riding on tires in winter that do not meet the required requirements may be fraught with a fine of 500 rubles. Even if this amount is not significant for you, you should not neglect the safety guarantee that such tires provide due to their better grip on the slippery road surface in the cold season.
