What does the law say?
In many media outlets, information was announced that in 2017 a law will come into effect, according to which a fine for summer tires in the winter in the amount of 2,000 rubles will be imposed.
At the moment, technical regulations are already in force, which determine that in winter all cars must be equipped with winter tires. The winter months are December, January and February. At the same time, the regulations state that all wheels of a car must have winter tires, and not only the front or rear axle, as some drivers believe.
In paragraph 5.5 of Appendix No. 8 it is said that the operation of vehicles without winter tires in winter is prohibited. It is also forbidden to use cars with studded tires in summer. It is also clearly stated in this paragraph that you cannot use cars that, although equipped with winter tires, have a residual tread depth of less than 4 mm. Therefore, it is not enough just to use winter tires, it must have a sufficient tread depth.
Is there a penalty for tires in winter?
Excerpts from the law clearly state that there are certain requirements for tires. They must be seasonally appropriate on all wheels at the same time. If the tires do not correspond to the season, then this is regarded as the technical condition of the car, which does not comply with the requirements of the rules. Penalty for different types of tires on the front and rear axles
Many drivers do not want to spend money on a whole set of winter tires, so they only buy tires for the drive axle - front or rear. While this is not recommended, many do.

Penalty for spiked tires in summer
If in spring or autumn you drive a car with ordinary winter tires without studs, then there will be no violation in this case. However, there is an exception to the rule, but it only applies to those regions of Russia where the cold climate predominates. Bald wheels
Regardless of what time of year and what type of rubber the driver uses, there are certain requirements for the tread pattern for both summer and winter tires.
- Cars of category L - 0.8 mm.
- Cars of categories No. 2, No. 3, OZ, 04 - 1 mm.
- Vehicles category M1, N1, O1, O2 - 1.6 mm.
- Cars category M2, M3 - 2 mm.
- Winter tires - 4 mm.
Why change tires at all?
It is worth noting that the fine for the tires did not appear out of the blue. It is known that summer tires become very hard at subzero temperatures. In addition, their tread pattern is not designed for snow or ice on the road. As a result, the use of such rubber in winter creates a high danger both for the driver and his passengers, and for other road users.

There are no specific rubber requirements in spring or autumn, so drivers can use both winter and summer tires. But experts recommend using summer tires, although in many regions they change their shoes only in summer, when the above-zero temperature outside the window lasts for a long time.

The essence of the current law on studded tires
The only law in force in Russia is TR CU 018/2011. From it, the following conclusions can be drawn: summer tires are allowed to be used from the beginning of March to the end of November, winter tires with spikes and M + S markings - from the beginning of September to the end of May, winter tires without spikes and M + S markings - all year round.
This means that from the beginning of June to the end of August it is forbidden to use tires on which there are protrusions, from the beginning of December to the end of February it is allowed to put winter tires without protrusions and with protrusions if it has a pattern:

Try to replace summer tires with winter ones from the beginning of September to the end of November. The time intervals are long enough, when to change tires, decide depending on weather conditions.
A separate type is all-season tires. They can be used from the beginning of December to the end of February only with the M + S marking. If there is no marking, this rubber is not considered winter, that is, at the end of November, tires are replaced.
Local authorities have the right to change the terms of the ban on certain types of tires only upward.
Draft Law No. 464241-6 on 01.11.2016 was sent for revision to the Legislation Committee and the Transport Committee. A working group was created from the deputies for revision. The Ministry of Internal Affairs gave recommendations on the procedure for taking into account the peculiarities of climatic conditions in different regions to agree on the terms of use of studded tires. If the bill is adopted soon, it will enter into force no earlier than September 1.

What kind of Technical Regulations are they and why are they needed?
The confusion over the fine for summer tires in winter (from December to February) arose due to clause 5.5 of the Technical Regulations of the so-called EAEU Customs Union.
The technical regulations of the Customs Union are an attempt by three friendly, economically connected states of Russia, Belarus and Kazakhstan to develop common standards for the safety of production and use of the most important products.
Conventionally, the Technical Regulations of the Customs Union can be equated to the Soviet GOST. The idea is to introduce general rules of the game, to bring national standards, regulations and rules to a single modern and safe model.
The technical regulations of the Customs Union regulate about 50 areas, such as pyrotechnic products, packaging, children's toys, food, etc. The rules for the operation of machines should be regulated by the regulations "On the safety of wheeled vehicles" (TR CU 018/2011), which formally entered into effective 1 January 2015.
Among other things, the Technical Regulations of the Customs Union "On the safety of wheeled vehicles" contains clause 5.5, to which the journalists of many major automotive publications refer.
Clause 5.5 of the Technical Regulations of the Customs Union (entered into force in 2015):

Winter tires are based on the regulations of the Customs Union, both studded and non-studded rubber products bearing the designation “M + S”, “M&S” and “M S” on the side surfaces, or a pattern in the form of a mountain with three peaks and snowflakes inside it.
Why is there a confusion about a fine for summer tires in winter?
Journalists regarded the strict wording of clause 5.5 of the Technical Regulations of the Customs Union as a ban on the operation of cars on summer tires in winter and on winter tires in summer. However, it is not!
The traffic police officer has the right to fine the driver or vehicle owner solely on the basis of clause of the Administrative Code. Can a traffic police officer fine for summer tires in winter 2017-2018?

As we said above, rumors that in the near future it will be prohibited at the legislative level to “shoe” a vehicle out of season have been circulating for a long time, and several bills have been submitted to the State Duma for consideration, but for various reasons, none have passed even the first reading. The essence of these tire bills boiled down to the following:
- To fine for driving a vehicle using out-of-season tires (the driver must either "change the car's shoes" taking into account the average daily temperature.
- To fine for the fact that the driver operates the vehicle on winter tires with spikes in the summer.

Is there a fine for winter tires in summer?
If you study the Technical Regulations of the Customs Union TR CU 018/2011 "On the safety of wheeled vehicles", it turns out that it brought new rules for Russian motorists. In this technical regulation, in paragraph 5.5 of Appendix No. 8, there are such provisions on the use of certain car tires at different times of the year:
- Summer tires can be driven from June to August (they must be studless).
- From December to February, drivers can take part in road traffic while driving a car “shod” in winter tires (studded or not).
- In CU regulation 018/2011 you will not find the concept of “all-season tires”.

If we talk about whether there is a fine for winter tires in the summer, then for a long time this issue remains unresolved. At the first stage of discussions, there were proposals for such violations to establish a fine of 5,000 rubles - but this initiative did not find approval from the deputies. There were also other proposals regarding the size of the fine for driving in summer on winter tires.
In fact, in 2020, there is a fine for driving on winter tires in summer only indirectly under Part 1 of Article 12.5 of the Code of Administrative Offenses of the Russian Federation, that is, if you left in the summer with a badly worn out tread ("bald" tires), the depth of which is less than 4 mm, then the fine for bald tires will be 500 rubles(or a warning).
What are the penalties for riding bald tires in 2020?
In the driving environment, the expression "bald rubber" has long been used, meaning driving on rubber, where the tread has worn off almost completely. Under the new regulations, riding on tires with worn out tread may result in punishment in the form of a fine of 500 rubles (or a warning)... If we refer to the SDA and its regulation on the admission of the vehicle to operation, then the driver is prohibited from taking part in road traffic if the residual height of the tread pattern of the tires of his vehicle:
- freight transport - less than 1 mm;
- passenger car - less than 1.6 mm;
- moped or motorcycle - less than 0.8 mm;
- bus - less than 2 mm.
According to Art. 12.5 of the Administrative Code of the Russian Federation, the traffic police can issue a fine to the driver for this violation - 500 rubles.
According to rumors, the deputies plan in the future at the legislative level to increase the amount of the fine for driving on bald tires by 4 times. Such a leap can be considered quite reasonable, since due to the fault of drivers who drive onto the road on bald tires, a huge number of accidents occur, especially during the winter months, when the roads are icy.
Will there be a ban on studded tires?
We talked about the requirements for vehicle tires in different seasons of the year, and now we will consider the question of what changes regarding the use of studded tires are planned at the legislative level.
For the countries that are members of the Customs Union, the technical regulation TR CU 018/2011, which we talked about above, sets the following conditions:
- Studded tires must not be used during the summer period - from June to August;
- Rubber with studded tread must be on all wheels of the vehicle (that is, it is impossible to have both studded tires and non-studded winter velcro tires at the same time;
- The maximum number of studs is prescribed per running meter of the tread - 60 pieces. This requirement will apply to rubber manufactured after January 1, 2016.
If we talk about potential fines for the use of rubber with spikes today, then they are not established at the legislative level! Therefore, drivers of the countries that are members of the Customs Union should not be afraid of penalties yet. But the fine for driving a car on studded tires, and you do not have the "Spikes" sign, is 500 rubles.
Riding on all-season rubber (Velcro) in 2020
Separately, it is worth mentioning about all-season tires, it is quite comfortable to ride on it by car both in winter and in summer. Actually, such non-studded all-season tires are designed for use on the road all year round.
Please note that such tires can be used in winter only if they are marked as "M + S", "M&S" or "MS" (which means "Mud & Snow", that is, in English "mud and snow" ) and although otherwise the use of all-season tires in the winter months is not allowed, there is still no penalty for this.
How will traffic police officers be able to fine for tires?
Above, we have already outlined the situation regarding the legal framework for seasonal tire change and penalties for the use of out-of-season tires. A natural question arises, how will the traffic police officers directly on the road monitor the drivers' compliance with the standards specified above?
Today, there is only the only possible way to establish the compliance with the seasonality of tires - it is to undergo a technical inspection. But here, too, there were some problems. For example, new cars that have just left a car dealership may not be inspected. Yes, and with cars in operation, too, not everything is clear - the duties of their owners include the passage of maintenance only once a year, which means that the compliance of tires with the season will be checked only once a year.
Summing up, I would like to note - despite the fact that out-of-season rubber penalties NOT introduced in 2020, every car owner must take a responsible approach to the issue of the readiness of his vehicle for the current road conditions! Today, there is no fine for using summer tires in winter, however, according to technical regulations, for driving a car that does not meet road safety requirements, a driver can be fined for using bald tires (i.e., for non-conformity of the tread). The penalty is provided for by Part 1 of Art. 12.5 Administrative Code and is equal to 500 rubles.
Mandatory use period for winter tires
The adopted law on studded tires caused a lot of questions and misunderstandings - when is it still necessary to carry out a seasonal tire change in order to avoid the danger of being prosecuted and fined?
If we talk about the timing of replacing tires with winter ones, then the requirements according to the text of the law in force, taking into account the amendments, are formulated as follows:
- It is forbidden to use tires with anti-skid spikes in the summer;
- It is forbidden to operate vehicles that are not equipped with winter tires that fully meet the requirements for them in the winter season;
- According to the regulations, vehicles must be equipped with winter tires for a period of 3 winter months (from December 1 - March 1) and summer tires for a period of 3 months (June - August). In some regions of the Russian Federation, according to the changes introduced by the executive authorities, such norms may be shifted towards their increase or decrease. For example, for Moscow from November 1. Such a wording is exclusively related to the peculiarities of the climate in each region - in some areas winter tires may not be in demand at all, and in others, on the contrary, its presence is required on a vehicle all year round.
Requirements for winter tires
In order not to get into a mess, you should understand exactly which tires, from the point of view of existing standards, can be regarded as winter tires. So, characteristics that winter tires must meet, the following:
- The minimum tread depth of a tire is 4 mm;
- The corresponding marking to be applied to the tires is a figure representing a 3-peak peak with a snowflake depicted in the center and its letter designation - M & S, M + S or M S;
- Lack of visible violations and damage to the tire. Such violations can include delamination of the coating, cuts and punctures, obvious tears, separation of layers along the side parts of the tires;
- No cracks in the disks, even if the tire itself is in full compliance with all the requirements;
- Missing part of the mounts on the discs (bolts or nuts);
- It is forbidden to install on one axle of a car (front, middle, rear, etc.) winter tires that differ in design, their design, model or type, degree of wear;
- The motorist is obliged to ensure that all wheels of his vehicle have winter tires that meet the requirements. For example, if there are winter tires on three disks, and summer tires on one, such a violation is already equated to driving a vehicle without winter tires.
Separate points that are of interest to vehicle owners is whether it is possible to drive in the winter season by a car with so-called velcro or all-season tires used as tires. In the event that such tires meet the necessary requirements in terms of their technical parameters and have the appropriate marking, then their use is not considered a violation.
It should be understood that riding on tires in winter that do not meet the required requirements may be fraught with a fine of 500 rubles. Even if this amount is not significant for you, you should not neglect the safety guarantee that such tires provide due to their better grip on the slippery road surface in the cold season.
