This circumstance somewhat discouraged the owners of these vehicles. They believed that it was permissible to travel on scooters and mopeds without the use of a motorcycle helmet. Meanwhile, driving without a helmet on a moped and scooter is a traffic violation.

It is not entirely clear from the point of view of common sense, what the owners of mopeds and scooters are guided by, moving along the highway without a helmet. Perhaps they are saving on buying it, or they hope for a lucky break and think that they are not in danger of an accident.

Important! According to the traffic rules, drivers and passengers are not allowed to travel on roads without a helmet on a scooter or moped.

The size of the fine in 2018

The grounds for imposing a fine for driving without a helmet is established by two articles of the Code of Administrative Offenses and Traffic Regulations:

  • Article 24.9 of the SDA prohibits movement on mopeds, scooters and bicycles without a helmet fastened with a special harness.
  • Article 12.6 of the Code of Administrative Offenses regulates the imposition of punishment for driving on the track without a helmet for motor vehicles.

The sizes of penalties for administrative offenses are periodically adjusted, so not all motor vehicle owners are aware of the fine for driving without a helmet in 2018. On June 19, 2015, the State Duma adopted amendments to the last article, and motor vehicle drivers will be punished with a fine of 1,000 rubles for driving without a helmet. Previously, the fine for this offense was equal to 500 rubles. Currently, a passenger of a motorcycle, moped or scooter is fined 500 rubles.

According to the traffic rules, a traffic police officer can draw up a protocol and fine the driver and passenger of a scooter, moped and motorcycle in two cases:

  • For riding without helmets.
  • For riding in an unbuttoned helmet.

What is the danger of riding without a helmet

Dashing scooters who neglect protective measures while driving often get into road accidents with rather serious health consequences. Moreover, most often the culprits of accidents are precisely the drivers of scooters and mopeds. The number of accidents involving scooters increases in the spring-summer period, when young reckless drivers drive onto the roads.

Unlike the driver of a car, who protects the body and seat belts during driving and a possible accident, the driver and passengers of motor vehicles are absolutely devoid of protection. That is why a special helmet is needed to protect against falls and collisions with a car.

Attention! Any accident involving a car and a scooter ends in failure for the latter. Drivers of scooters, mopeds and motorcycles in a collision with a car most often receive injuries incompatible with life. Head injuries are especially dangerous and can be minimized by a protective helmet.

Consequences of an accident involving a scooter

Most often, it is scooter drivers who provoke accidents, who do not have a license and do not follow the traffic rules. The lack of rights of the scooter does not relieve him of responsibility.

The grounds for initiating a criminal case involving the scooter driver are contained in article 264 of the Criminal Code. The maximum punishment under this article is 2 years in prison. If a scooter causes serious harm to human health, he will be punished with imprisonment for 3 years.

Some features have the appointment of a punishment to the driver of a car if he broke the rules and caused harm to the driver of the scooter. If a scooter got into an accident while moving without a helmet and injured his head, the court will disregard this. The scooter, moving without a helmet, is to blame for the head injury, and the driver will not be punished for this.

The driver of the scooter or moped will also be found guilty of causing injury to the passenger. Article 1079 of the Civil Code makes the owner of the vehicle responsible for causing injury to another person. Consequently, even if the culprit of the accident is a motorist, responsibility for injuries to a passenger of a motor vehicle rests with its driver. Eventually, a scooter driver in an accident can receive not only an administrative fine, but also a criminal penalty.

Is it possible to avoid punishment

Motorcyclists and scooters mistakenly believe that they can avoid punishment for driving without a helmet if they simply hide from the traffic police. This opinion was formed thanks to the allegedly existing law prohibiting inspectors from chasing the owners of motor vehicles moving without a helmet.

In fact, there is no such law. This misconception has developed because inspectors often refuse to chase riders without a helmet on a moped, motorcycle or scooter so that they do not provoke an accident. But there is no prohibition to pursue dashing drivers, so the outcome of the case depends entirely on the decision of the traffic police officers.

Advice! A real opportunity to avoid punishment is a statement by a motorcycle driver that he unbuckled his helmet after stopping, while waiting for an inspector.

But when there is no helmet on the head, in principle, it will not be possible to avoid punishment. You can only reduce it by half by paying for the issued receipt within 20 days after the entry into force of the resolution (Article 32.3 of the Administrative Code).

Any fine for driving without a helmet is just a loss of money, which is not so terrible compared to the loss of health or death of a person. A person who sets off on a motorcycle, moped or scooter should remember first of all that their life depends on equipment. This is what you should first think about when driving on the track without a protective helmet.
